In the name of God Amen. I Simon Peacock of Reeth in the parish of Grinton in the County of York Gentleman do make this my last Will and Testament in manner following. I give all my household Furniture Plate Linen China Books Prints Pictures Brewing Utensils and Milk vessels and all other my Implements of household of whatever description to my dear Cousin Ann Orton to and for her own use and benefit absolutely freed and exonerated from the payment of my debts. I give and devise to hte said Ann Orton all my Mefsuages Cottages Lands Tenements and hereditaments whatsoever which are of freehold tenure situated in the town of Reeth and also such parts and parts of the Farm and Lands now in Francis Raw's occupation as my tennant situate lying and being between Reeth and Healaugh with their appurtenances To hold the same and every part thereof to the said Ann Orton for and during the term of her natural life without impeachment of waste I give and devise to her niece Charlotte Orton all and every my Mefsuages lands Tenements and hereditaments situate at Reeth aforesaid and in the occupation of the said Francis Raw which are of Copyhold tenure with their and every of their appurtenances To hold the same and every part thereof to her the said Charlotte Orton and her assigns for and during the term of her natural life without impeachment of waste and from and after the death of the said Ann Orton in case the said Charlotte Orton shall happen to survive her I give the said freehold Mefsuages Lands tenements and hereditaments hereinbefore devised to the said Ann Orton for her life to her the said Charlotte Orton to hold the same to her the said Charlotte Orton in and during the term of her natural life without impeachment of waste and on the death of the said Charlotte Orton I give and devise all and singular the before mentioned Mefsuages Lands Tenements and hereditaments both freehold and copyhold with their and every of their apurtenances unto and amongst all and every the Child and Children of the said Charlotte Orton lawfully to be begotten their heirs and afsigns for ever if more than one to take as Tenants in Common and not as joint Tenants and if there shall be but one such Child then to his or her heirs or afsigns. // Simon Peacock // for ever but if the said Charlotte Orton shall happen to die without leaving lawful ifsue surviving her then I give and devise all and singular the before mentioned Mefsuages Lands Tenements and Hereditaments with their and every of their appurtenances and my firends John Barker of Healaugh in the said Parish of Grinton and James Sherlock of Owlands in the parish of Marrick in the said County Gentlemen their heirs and afsigns Upon the trusts hereinafter mentioned exprefsed and declared of and concerning the same I also give to the said Ann Orton and Charlotte Orton the Legacy or Sum of twenty five pounds each for each and every year they shall continue to live with me to commence and be computed from the date of this my Will up to the day of my death as a compensation and equivalent for their services to and care of me. I forgive and remit to each and every of my Tenants One quarters Rent to be computed from the last half years payment next preceding the date of my death and i give to the deserving poor of the Township of Reeth the Legacy or sum of thirty pounds clear of Legacy duty to be distributed among them at the discretion of my Executors only I wish to observe that William Wensley will have already received his share I give to Ann Day and Jane her daughter each the Legacy or Sum of ten pounds all the before named Legacies to be paid by my Executors at the expiration of six months next after my death. I give to Lucy Coats of Reeth aforesaid Spinster the annuity or yearly sum of fifteen pounds to be paid to her by my executors hereinafter named for and during the term of her natural life and up to the day of her death by four equal quarterly payments at the four most usual Feast or Quarterly days of payment in each year the first quarters payment thereof to be made on the day of my funeral I give and devise all the rest residue and remainder of my Mefsuages lands Tenements and hereditaments whatsoever and wheresoever with their and every of their appurtenances unto the said John Barker and James Sherlock. To hold the same and every part thereof unto the said John Barker and James Sherlock their heirs and afsigns for ever according to the several natures and qualities thereof Upon the Trusts hereinafter mantioned that is to say Upon trust that they the said John Barker and James Sherlock // Simon Peacock // or the survivor of them or the heirs and assigns of such survivor do and shall at any time when they shall think proper sell and absolutely dispose of the same either together or in parcels by public auction or private contract as they in their discretion shall think best for the most monies and best prices which can be reasonably obtained for the same and to convey the same respectively to the respective purchaser and purchasers thereof. And my Will further is that the monies which shall arise by or from such sale or sales as aforesaid shall be deemed to be part of my personal estate and that the clear yearly rents and profits of the said hereditaments and premises in the meantime until the same shall be sold or of so much thereof as shall be remaining unsold shall be deemed to be part of my personal estte and that the same monies and rents and profits shall be subject to the dispositions hereinbefore made concerning my personal estate and as touching the residue of my personal estate remaining after payment of my debts funeral expences the costs and charges of proving and registering this my will and the Legacies hereinbefore mentioned. I give the same to the said John Barker and James Sherlock their executors administrators and afsigns Upon the trusts and for the intents and purposes and under and subject to the powers provisoes and declarations hereinafter exprefsed and declared of and concerning the same that is to say upon trust to devied such monies unto and equally among my second cousins the Children of the following persons, namely, Francis Peacock of Marrick, Dorothy Robinson of Marrick, Henry Peacock of Stockton, Thomas Peacock of Burton, Thomas Peacock of Grinton, Dorothy Cooper of Grinton, Henry Fryer of Downholme his sister Mary Fryer of Downholme and Thomas Fryer of Reeth each of my second cousins taking an equal share of the said trust monies except Dorothy the wife of Thomas Lambert to whom I give two shares or twice as much as any of the others and I declare my Will to be that my said Trust shall pay and devise the aforesaid monies unto and among my second cousins only who shall be living at my death and not to any others or the decendants of such as may be then dead and as touching the said Mefsuages land Tenements and hereditaments hereinbefore by me given // Simon Peacock // and devised unto the said John Barker and James Sherlock their heirs and assigns in the event of the said Charlotte Orton dying without leaving lawful ifsue surviving her it is my Will and mind that the same shall be held and disposed of by my said Trustees their heirs or afsigns and the monies to arise from the sale thereof Upon the same trusts and for the like intents and purposes in all respects as the Mefsuages Lands Tenements and hereditaments last mentioned are before devised to them. I give and devise all Estates vested in me upon any Trust or by way of Mortgage to the said John Barker and James Sherlock their heirs executors administrators and afsigns for ever or for all such Estate and interest as I may be possessed of therein respectively Upon the trusts and subject to the equity of redemption subsisting or capable of taking effect...........

A codicil to the last Will and Testament of me Simon Peacock of Reeth which will was dated the Tenth Day of November One thousand eight hundred and twenty seven now my Will and mind is, and I do hereby give and bequeath unto Ralph Fothergill Senr of Reeth the sum of five pounds unto his wife five pounds and a black gown his son Joseph Fothergill five pounds and to his wife Margaret one black gown and to his son John a suit of clothes hat shoes and to his daughter Rachel a black gown his daughter Esther a black gown to his son Ralph two pounds in money to Mifs Margaret Simpson and to her sister Mifs hannah Simpson both of Reeth the sum of five pounds each as a token of friendship to be paid within twelve months after my decease. I also order my funeral to be conducted on the same plan as that of my late dear wife and I also authorize my Executors to errect on Marble Monuments to the memory of my late Grandfather Thomas Peacock of Marrick my father and mother both late of Reeth and to my sister late of West Witton and to my Aunt Orton late of Reeth and of my dear wife and that of myself and to be placed in the parish Church of Grinton and if convenient to be affixed over my pew the expence of which shall not exeed one hundred pounds. Witnefs whereof I have hereunto set my hand and seal this twenty first day of December One thousand eight hundred and twenty seven.
